2.3. Why Do We Need Constraints?

We cannot live in a world where there are no constraints. We need some constraints or else society would descend into chaos. Differences may exist between people regarding their ideas and opinions, they may have conflicting ambitions, they may compete to control scarce resources.

In any society, individuals have different beliefs, desires, and wants. If everyone acted solely based on their opinions, conflicts would arise. Constraints help to manage these differences. Without constraints, we risk chaos, where the strong impose their will on the weak.

Consider a classroom without rules. If everyone talked at once, it would be impossible for anyone to learn. Rules, like raising hands to speak, are constraints that allow for a structured environment where all can participate.

Therefore every society needs some mechanisms to control violence and settle disputes. So long as we are able to respect each other’s views and do not attempt to impose our views on others we may be able to live freely and with minimum constraints.

Mechanisms, such as laws and regulations, are essential to address conflicts. They provide a way to resolve disagreements peacefully, promoting understanding and tolerance among people. Ideally, individuals should respect differing opinions to maintain harmony.

Think of a soccer game. Referees enforce the rules to handle disputes about fouls and scores. Without referees, players might argue constantly, disrupting the game. Similarly, laws act as referees in society.

However, sometimes, we think that a strong commitment to our beliefs requires that we must oppose all those who differ from or reject our views. Under such circumstances we need some legal and political restraints to ensure that differences may be discussed and debated without one group coercively imposing its views on the other.

People often feel strongly about their beliefs and may react negatively toward differing views. Legal constraints help protect minority opinions and encourage respectful dialogue, preventing dominant groups from silencing others.

Consider a debate in a democracy. Laws protect the right to voice differing opinions, ensuring that everyone can express their beliefs without fear of reprisal. This encourages open discussion and a more informed society.

But the creation of such a society too requires some constraints. At the very least, it requires that we be willing to respect differences of views, opinions and beliefs.

Creating a society where everyone's beliefs are respected requires some level of constraint. This doesn't mean limiting freedom but rather upholding mutual respect and understanding, which contributes to a more cohesive society.

In a diverse community, respecting each other's traditions and practices requires individuals to constrain their actions sometimes. For instance, one might choose to not speak negatively about a cultural practice to foster harmony.

However, we must make sure that the constraints imposed are not so severe that they destroy freedom itself.

While constraints are necessary for harmony, they can sometimes become too restrictive. When constraints infringe too much on personal freedoms, they can lead to resentment and rebellion. Finding a balance is key.

Think of a curfew imposed on teenagers. While it aims to keep them safe, if it's too strict, it may lead to feelings of rebellion against parental authority. The goal should be to ensure safety without restricting freedom excessively.

In the constitutional discussions in India, the term used for such justifiable constraints is 'reasonable restrictions'.

Reasonable restrictions are constraints that are necessary to maintain public order and safety while still upholding individual freedoms. They should be proportionate and not excessive relative to the actions they restrict.

Consider noise ordinances in neighborhoods. They restrict loud noises late at night to ensure a peaceful environment. This is a reasonable restriction that still allows people to enjoy their freedom during appropriate hours.
